As a crossroads course, this seminar aims to promote the interdisciplinarity that characterises the bachelor programme and to develop your ability to theorise legal phenomena.
By the end of the seminar, you should have
  • opened your mind to fundamental questions and critical reflection on the law
  • developed your ability to understand legal theory writings, synthesise them and critique legal doctrine in a group discussion;
  • critically examined a theoretical issue of your choice, through personal research (including with regard to productions by artificial intelligence)
  • written an analysis based on legal sources and other disciplines, hence from an interdisciplinary perspective, in an academic style and in accordance with the requirements of scientific probity.
 
Content
The "Treasure" of the Faculty of Law, the Seminar on Legal Theory invites you to undertake personal research, building upon the theoretical framework established in the course "Introduction à la pensée juridique contemporaine".
The seminar is structured in two parts, consisting of the reading of theoretical texts followed by the writing of an essay
Teaching methods
1. The seminar is first and foremost a group dynamic activity: in class, we will read and discuss texts on various general topics in legal theory. These texts differ in their approaches but are consistently conceptual, critical, and interdisciplinary.
The texts will be made available to you on moodle, together with tsummaries or analyses generated by artificial intelligence. You are also required to read these summaries or analyses as they will be the subject of debates.
2. Additionally, you will receive guidance in writing a personal research paper that examines the relevance of a proverb, saying, or other piece of "popular wisdom" within the legal domain. The goal is for you to engage in personal reflection on positive law, particularly by integrating a non-legal perspective with legal analysis.
Your essay should be 7500 words long (including footnotes, excluding annexes).
As a preamble to this work, you must include the response provided by an AI to your research question, along with a brief explanation of 500 words detailing how you have engaged with this response. In this explanation, you may describe how you either distanced yourself from or integrated the AI-generated propositions into your essay, highlight what you found relevant or lacking, point out ideas and gaps in terms of sources, specify the questions you asked before obtaining a useful response, etc.
There will be no pre-correction of texts, but you will be invited to refine and test your hypotheses with your fellow students and your professor during three sessions at the beginning of the second term. You are strongly advised to prepare a text (outline, chapter, summary, etc.) before taking part in these discussions.
The submission deadline for the first session is Friday, May 16, 2025, at 11:59 PM, and for the second session, it is Friday, August 15, 2024, at 11:59 PM. The date and time of submission on Moodle will be considered definitive. No email submission or printed version is required.
Evaluation methods
No pre-correction of your drafts will be offered, but you will be invited to refine and test your hypotheses with your professor if you wish.
The evaluation of your essay will be based on the structure of your argument, the formulation and relevance of your research question, the interdisciplinary nature of your sources and arguments, the overall understanding of the issue and literature, the quality of your research, the originality of your reasoning, the quality of your writing, and your methodology. Additionally, you will be assessed, albeit to a much lesser extent, on your participation in the reading sessions. Three out of twenty points will be based on your critical engagement with the response provided by artificial intelligence (see above).
In the case of justified delays, the deadline for submission will be extended by the number of days corresponding to the difference between the start date of the medical certificate and the originally scheduled submission date, up to a maximum of 10 days.
For unjustified delays, 2 points per 24-hour period will be deducted from the total grade; a delay of more than 5 days, submission of a non-authentic paper, or failure to submit will result in a grade of absence (0A).
